Remote testimony
A witness testifies by video only when the court allows it, and the court names the platform. Parties book a video interpreter around a trial in the situations below.
A witness who lives far from the courthouse may testify by video if the court allows it. The interpreter joins the court's link as a guest and interprets each question and answer for the witness.
Some trials need testimony from a witness in another country, if the court permits it. Add the court's link to the booking as soon as you have it, and tell us the witness's language.
Before the trial, attorneys go through the questions with a witness who speaks another language. Book each preparation session separately from the trial days, and ask for the same interpreter if you want one person throughout.
Trials by video
A trial is held in a courtroom, and video comes in for one part of it, a witness who testifies from somewhere else. A court may allow this for a witness who lives in another state or abroad, and the court decides each request. Video is also used for preparation sessions before the trial, and when no interpreter for the witness's language works near the courthouse.
The judge presides and decides how the remote testimony is taken. Attorneys question the witness, and the witness answers under oath from another place. A court reporter writes down the record, and the jury hears the testimony in the courtroom. The interpreter joins the same link as a guest, and each speaker pauses so the interpreter can interpret that part.
The interpreter interprets each question into the witness's language and each answer into English, in the first person and in full, so the record holds the witness's own words. Everything said to the witness is interpreted, including the judge's instructions. The interpreter works for neither side, adds nothing, explains nothing and keeps what they hear confidential.
Testimony by video
Before the trial, order certified translations of the exhibits that are in another language. Add the exhibit list and the translated copies to the booking notes in your dashboard, so the interpreter knows the documents the witness will be asked about.
